Privacy Policy

This Privacy Policy describes how Jake Team LLC, a Texas limited liability company (“Jake Team,” “we,” “us,” or “our”), collects, uses, shares and protects information in connection with lexregister.com and lexcircuit.com, their subdomains, RSS and other feeds, email newsletters, social media accounts, application programming interfaces and related services (together, the “Sites”). Jake Team is the controller of the personal information described in this Policy.
By using the Sites you acknowledge this Policy. If you do not agree with it, do not use the Sites. This Policy is not part of, and does not create rights under, our Terms of Service; it describes our practices, and we will honor the choices and rights it sets out.
1. Summary
- The Sites are static pages. You can read every story without creating an account and without giving us any information about yourself.
- We collect information you give us directly (a newsletter email address; the contents of a tip, correction request, advertising inquiry or contact message) and information collected automatically when you visit (server logs, analytics, and cookies set by advertising partners).
- We use it to run the Sites, send newsletters you asked for, investigate and report stories, measure readership, display advertising, protect the Sites, and comply with law.
- We do not sell personal information for money. Third-party advertising on the Sites may involve cookies or similar technologies that some laws treat as a “sale” or “sharing” of personal information or as “targeted advertising.” You can opt out as described in Section 9.
- We honor the Global Privacy Control browser signal as an opt-out of targeted advertising and of any sale or sharing of personal information, without requiring you to do anything else.
- Residents of California, Texas and other U.S. states with privacy laws, the European Economic Area, the United Kingdom and other jurisdictions have rights described in Sections 9 and 10.
2. Information we collect
2.1 Information you provide
- Newsletter subscriptions. Your email address, the date and source of your subscription, your confirmation of subscription, and your subscription preferences. This information is held in an access-controlled store separate from the public Sites, operated for us by our infrastructure provider and, for delivery, by an email-delivery provider.
- Tips, corrections and contact messages. Your name, email address, and whatever you choose to include in the message, including any documents you attach. We ask you not to send confidential, privileged or unnecessary personal information; see Section 6 of the Terms of Service.
- Advertising and sponsorship inquiries. Business contact details, company name, and the content of your inquiry.
- API and automated-submission credentials. If we issue you credentials for an API, the name, organization, email address and technical identifiers associated with them, and logs of their use.
- Arbitration opt-outs, privacy requests and other correspondence. Whatever you include in the message and what we need to respond and keep a record.
2.2 Information collected automatically
- Server and security logs. When you visit the Sites, our hosting and content-delivery provider (currently Cloudflare, Inc.) automatically records your IP address, approximate location derived from it, browser type and version, operating system, device type, referring URL, pages requested, timestamps, request headers, and security signals used to detect bots and attacks.
- Analytics. We use analytics to understand how the Sites are used: which pages are read, from what kind of device and region, and how visitors arrive. Our analytics are collected through privacy-preserving, cookieless measurement provided by our content-delivery provider (currently Cloudflare Web Analytics), which does not use cookies or persistent identifiers and does not track you across sites. If we ever add an analytics service that uses cookies or similar identifiers, we will update this Policy and, where a consent requirement applies to you, run it only after you consent.
- Advertising technology. The Sites may carry advertising. Sponsorships that we sell directly are served from our own pages without third-party tracking. If we serve advertisements through third-party advertising partners, those partners may set cookies, pixels, local storage or similar technologies on your device when an advertisement loads, and may collect identifiers, IP address, browsing information on the Sites, and inferences to select and measure advertisements. Where a consent requirement applies to you, such technologies are activated only after you consent, and this Policy will identify the partners in use.
- Email engagement. Our newsletters may include a tracking pixel and tracked links that tell us whether an email was opened and which links were clicked, together with the approximate time, device and location of that activity.
- Feeds and APIs. When a reader or agent fetches an RSS feed or calls an API, we log the IP address, user agent, credential (if any), endpoint and timestamp.
2.3 Information from other sources
We may receive information about you from advertising partners (aggregate campaign measurement), from public sources, and from people who send us tips or other Submissions that mention you. Because the Sites are a news publication, we also collect and publish information about people in the course of reporting, as described in Section 11.
2.4 Information we do not collect
We do not ask for, and ask you not to send, government identification numbers, financial account details, health information, precise geolocation, or biometric information. We do not knowingly collect personal information from children under 13.
3. How we use information
We use the information we collect to:
- operate, secure, maintain and improve the Sites, including detecting and preventing abuse, fraud, scraping, denial-of-service attacks and other unauthorized activity;
- send you newsletters you subscribed to, and service messages about your subscription or about our terms and policies;
- receive, evaluate, investigate, verify and respond to tips, corrections requests, takedown requests and other Submissions, and to report stories;
- measure readership and understand how the Sites are used, so that we can decide what to cover and how to present it;
- display, target, cap the frequency of and measure advertising, and report aggregate results to advertisers;
- respond to advertising, sponsorship, licensing, API and partnership inquiries and administer any resulting relationship;
- comply with legal obligations, respond to lawful requests, and establish, exercise or defend legal claims, including under our Terms of Service;
- enforce our Terms of Service and protect the rights, property and safety of Jake Team, our readers, our sources and the public; and
- for any other purpose disclosed to you when the information is collected or to which you consent.
Where the EU or UK General Data Protection Regulation applies, our legal bases are: performance of a contract or steps at your request (newsletters, API credentials, responding to your messages); our legitimate interests (operating and securing the Sites, measuring readership, journalism, enforcing our terms, defending claims), balanced against your rights; consent (cookie-based analytics and advertising where consent is required, and marketing where required); and compliance with legal obligations.
4. How we share information
We share personal information only as follows:
- Service providers. With vendors that process information on our behalf and under contract, including hosting and content-delivery providers, edge-computing and database providers, email-delivery providers, analytics providers, security and bot-management providers, form and ticketing tools, and professional advisers. They may use the information only to provide services to us.
- Advertising partners. Third-party advertising networks and exchanges that serve advertisements on the Sites collect information directly through their own technologies, as described in Section 2.2, and use it under their own privacy policies. Section 9 explains how to opt out.
- Legal and safety. When we believe in good faith that disclosure is required by law, subpoena, court order or governmental request; to enforce our Terms of Service; to detect, prevent or address fraud, security or technical issues; or to protect the rights, property or safety of Jake Team, our readers, our sources or the public.
- Business transfers. In connection with a merger, acquisition, financing, reorganization, bankruptcy or sale of all or part of our business or assets, in which case the recipient will be bound by this Policy with respect to the transferred information.
- Affiliates. With entities under common ownership or control with Jake Team, which will honor this Policy.
- With your consent or at your direction.
- Aggregated or de-identified information, which does not identify you, for any purpose.
Sources. We treat the identity of a person who provides a news tip as confidential and will not voluntarily disclose it, except where the person consents, where the tip is knowingly false or submitted for an unlawful purpose, or where disclosure is required by law after we have raised the objections we consider appropriate. We cannot guarantee anonymity, and we may be compelled by law to disclose a Submission or information about its sender; see Section 6.4 of the Terms of Service.
5. Cookies and similar technologies
We set no first-party cookies of our own to let you read the Sites. Technologies that may be present are:
- Strictly necessary. Security and bot-management cookies that our content-delivery provider may set to protect the Sites. These cannot be disabled.
- Analytics. Cookieless measurement as described in Section 2.2.
- Advertising. If third-party advertising is served, cookies and similar technologies set by advertising partners to serve, target, cap and measure advertisements, subject to consent where required.
You can control cookies through your browser settings, and most browsers let you refuse or delete them. Where we display a consent banner, you can change your choices through it at any time. Disabling cookies does not affect your ability to read the Sites. We respond to the Global Privacy Control signal by treating it as a valid opt-out of targeted advertising and of any sale or sharing of personal information for the browser that sends it, without any further action by you. We do not otherwise respond to “Do Not Track” signals, for which no common standard has been adopted.
6. Data retention
We keep personal information only as long as necessary for the purposes in Section 3, and then delete or de-identify it, subject to legal retention obligations and our need to establish or defend claims. As a guide: newsletter subscription records are kept while you are subscribed and for a short period after you unsubscribe to honor suppression; server and security logs are kept for a limited period set by our providers; tips and correspondence are kept as long as they are relevant to reporting, corrections or legal exposure, which for published stories may be indefinitely; and analytics data is retained in aggregate form.
7. Security
We use administrative, technical and physical safeguards appropriate to the sensitivity of the information, including encryption in transit, restricted access to any working store, and authentication in front of any administrative system. The public Sites are static pages that hold no reader data; newsletter subscriptions and Submissions are held in separate, access-controlled systems. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we learn of a breach affecting your personal information, we will notify you and any regulators as required by applicable law.
8. International transfers
Jake Team is located in the United States, and the Sites are hosted on infrastructure that may process information in the United States and in other countries where our providers operate. If you access the Sites from outside the United States, your information will be transferred to, stored and processed in the United States, where privacy laws may differ from those in your jurisdiction. Where the GDPR or UK GDPR applies, we rely on standard contractual clauses or other approved safeguards for transfers to our providers, and on your consent or the necessity of the transfer for the service you requested where those safeguards are not available.
9. Your privacy rights in the United States
9.1 Rights available to residents of states with comprehensive privacy laws
If you are a resident of California, Texas, Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Delaware, Iowa, Nebraska, New Hampshire, New Jersey, Tennessee, Minnesota, Maryland, Indiana, Kentucky, Rhode Island or another state with a comprehensive privacy law that applies to us, you may have the right, subject to the law’s conditions and exceptions, to:
- confirm whether we process your personal information and access it;
- correct inaccuracies in it;
- delete it;
- obtain a portable copy of it;
- opt out of the processing of your personal information for targeted advertising, for its sale, and for profiling in furtherance of decisions that produce legal or similarly significant effects; and
- not be discriminated against for exercising these rights.
Under the California Consumer Privacy Act (as amended by the California Privacy Rights Act) you also have the right to know the categories and specific pieces of personal information we have collected, the categories of sources, the purposes, and the categories of third parties to whom it was disclosed, sold or shared, and to limit the use of any sensitive personal information (which we do not collect). Section 2 describes the categories of personal information we collect, which under California law fall into: identifiers; internet or other electronic network activity information; approximate geolocation; commercial information (advertising inquiries); professional information (advertising and API contacts); and inferences drawn by advertising partners. We do not use or disclose sensitive personal information, and we have not knowingly sold or shared the personal information of consumers under 16.
9.2 Your Privacy Choices: opting out of targeted advertising, sale and sharing
We do not sell personal information for monetary consideration. If third-party advertising partners collect information through cookies on the Sites for cross-context behavioral advertising, that activity may constitute a “sale” or “sharing” under California law and “targeted advertising” under other state laws. To opt out, do any of the following: enable the Global Privacy Control in your browser, which we honor automatically for that browser; use the cookie-settings control on the Sites where one is displayed; or email info@jaketeam.com with the subject line “Privacy Request” and the words “opt out of targeted advertising.” A browser-based opt-out applies to the browser and device you are using. The “Your Privacy Choices” link in the footer of the Sites brings you to this section.
9.3 How to exercise your rights
Email info@jaketeam.com with the subject line “Privacy Request,” state which right you are exercising and which state you live in, and give us enough information to identify you (for a newsletter subscriber, the subscribed email address is usually sufficient). We may ask you to verify your identity before acting on a request, and we may decline requests that are manifestly unfounded, excessive or that would require us to remove or alter published journalism (see Section 11). We will respond within the time required by the applicable law, generally 45 days, and will tell you if we need an extension.
Authorized agents. You may designate an authorized agent to make a request on your behalf. We will ask the agent for written authorization signed by you and may ask you to confirm the request directly.
Appeals. If we decline your request, you may appeal by replying to our response with the subject line “Privacy Appeal.” We will respond to appeals within the period required by the applicable state law. If we deny your appeal, you may contact your state attorney general; for Texas residents, the Office of the Texas Attorney General at https://www.texasattorneygeneral.gov/consumer-protection/file-consumer-complaint.
9.4 Texas residents
Jake Team is a Texas company and processes personal information subject to the Texas Data Privacy and Security Act to the extent that law applies. Texas residents have the rights in Section 9.1, the opt-outs in Section 9.2 and the appeal right in Section 9.3. We do not sell sensitive personal data and do not sell any personal data for money.
9.5 Nevada residents
We do not sell covered information as defined in Nevada Revised Statutes Chapter 603A. Nevada residents may submit a request to us at info@jaketeam.com to record their opt-out preference in case that changes.
10. Your privacy rights in the European Economic Area, the United Kingdom and elsewhere
If you are in the EEA, the UK or Switzerland, you have the right, subject to conditions and exceptions, to access, rectify, erase and receive a portable copy of your personal data; to restrict or object to its processing, including processing based on legitimate interests and any direct marketing; to withdraw consent at any time where consent is our legal basis, without affecting prior processing; and to lodge a complaint with a supervisory authority, in particular in the member state of your habitual residence, place of work or the place of an alleged infringement. For the UK, the supervisory authority is the Information Commissioner’s Office (ico.org.uk). To exercise these rights, email info@jaketeam.com with the subject line “Data Protection Request.” We have not appointed a representative in the EU or UK.
Processing carried out for journalistic purposes is subject to the exemptions in Article 85 of the GDPR and the equivalent provisions of UK and member-state law; see Section 11.
If you are in Canada, Australia or another jurisdiction with data-protection law, you may have comparable rights, which you may exercise through the same contact.
11. Journalism, public figures and people named in our reporting
The Sites are a news publication. In the course of reporting we collect, process and publish information about people, including lawyers, judges, executives, founders, investors, academics, regulators and other individuals involved in the developments we cover. That processing is carried out for journalistic purposes in the public interest, on the basis of our legitimate interests and of the journalistic exemptions in the GDPR, UK GDPR, CCPA and other privacy laws.
Privacy-rights requests are not a mechanism for editing or removing published journalism. If you believe a story about you is inaccurate, please use the Corrections process, which is described in our Disclaimer. We will consider every request in good faith, but we do not remove accurate reporting on matters of public concern.
12. Children
The Sites are not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. Newsletters and Submissions are intended only for people 18 or older, and subscribers and senders represent that they meet that requirement. If you believe a child under 13 has given us personal information, contact us at info@jaketeam.com and we will delete it.
13. Newsletters and marketing
You can unsubscribe from any newsletter at any time by clicking the unsubscribe link in any email or by emailing info@jaketeam.com. We comply with the CAN-SPAM Act and, for recipients where they apply, Canada’s Anti-Spam Legislation and the ePrivacy rules of the EU and UK. Unsubscribing from newsletters does not prevent us from sending non-promotional service messages when necessary.
14. Third-party links and services
The Sites link to third-party websites, including source articles, court dockets, regulator websites and vendor websites, and may embed third-party services. Those third parties have their own privacy practices, which we do not control and for which we are not responsible. Review their policies before providing them any information.
15. Changes to this Policy
We may update this Policy from time to time. The effective date at the top indicates when it was last revised. If we make material changes, we will post a prominent notice on the Sites and, where we hold your email address for a newsletter, may notify you by email. Your continued use of the Sites after a revised Policy is posted constitutes acknowledgment of it.
