Court of Appeal says judges sentencing by live link should be rare and cuts fraud sentence for guideline errors

In R v Priestley [2026] EWCA Crim 1284, the Court of Appeal said a judge sentencing by live link, especially where custody is likely, should be rare and administrative convenience is not enough; the resident judge should be consulted, counsel given reasons and a chance to object, and a short ruling uploaded to the digital case system. It cut Frederic Priestley's fraud sentence from 35 to 24 months for harm-category and mitigation errors but refused to suspend it.

Court of Appeal quashes five former Barclays traders' rate-rigging convictions after Hayes ruling

The Court of Appeal of England and Wales on October 7 quashed the Libor and Euribor conspiracy-to-defraud convictions of former Barclays traders Jay Merchant, Jonathan Mathew, Alex Pabon, Philippe Moryoussef and Colin Bermingham. In Patel v General Optical Council [2026] EWCA Civ 1206, handed down on September 22, 2026, the Court of Appeal refused permission for a second appeal by suspended optometrist Suleman Patel but held Deputy High Court Judge Richard Clayton KC should not have heard the High Court appeal remotely from bed while recovering from Achilles surgery. Lord Justice Phillips, with Lady Justice Falk, said bed hearings should be a last resort when conventional listing is not feasible.
