Missouri suspends dyed-diesel highway ban for any purpose under Executive Order 26-20

Under Executive Order 26-20 (Oct. 9, 2026), Gov. Mike Kehoe suspended enforcement of Missouri's on-highway dyed-diesel ban (RSMo 142.932) and its penalties for any purpose. No state agency or officer may assess penalties under that section. The order replaces EO 26-19 and keeps a 90,000-pound limit for qualifying farm loads on non-interstate roads. It ends Dec. 31, 2026 unless extended.

The Supreme Court of the United States granted an emergency application for a stay in People Not Politicians v. Onder, blocking lower federal court orders that required Missouri to use a 2025 congressional redistricting map in the 2026 elections. The per curiam order held under the Purcell principle that federal courts cannot alter election rules while voting is actively underway, and reaffirmed that the state must conduct elections under its 2022 map.
