Amsterdam Enterprise Chamber rejects shareholder inquiry into Philips sleep apnea recall, finding no reason to doubt its policy
The Enterprise Chamber of the Amsterdam Court of Appeal rejected a request by the VEB investors' association and institutional investors for an inquiry into Philips over its 2021 sleep apnea recall. It found no well-founded reasons to doubt Philips' policy: internal systems followed international standards, reliable foam-risk data emerged only in early 2021, the boards were not informed late, supervision was not shown lacking, earlier intervention at Respironics was not required, and disclosures were not misleading.
