California bars AI from independently performing licensed clinical functions and brings health chatbots under medical privacy law
Governor Gavin Newsom signed AB 1979 on September 30, 2026. From January 1, 2027, health facilities, clinics and physician offices may not use AI to independently perform clinical functions the law reserves for licensed professionals, and must ensure licensed clinicians keep independent judgment when care is informed by clinical decision support systems. Businesses offering health care chatbots to consumers become providers subject to the Confidentiality of Medical Information Act.
