Nebraska declares fuel emergency, allows untaxed dyed diesel on highways

Governor Jim Pillen signed Executive Order 26-21 on September 24, 2026, declaring a statewide emergency over distillate fuel shortages. For 90 days, registered highway vehicles may hold and use untaxed dyed diesel without state penalty, sales of the fuel to those operators are permitted, the Tax Commissioner must seek IRS penalty relief within three business days, and diesel taxes on Nebraska agricultural hauling are refundable via Form 84AG.
