California exempts tribal contracts from competitive-bidding rules
Governor Gavin Newsom signed AB 2187 on September 25, amending Public Contract Code section 10340 so state agencies may contract with federally recognized California Native American tribes without securing three competitive bids. A tribe fulfilling such an interagency agreement may subcontract with its wholly owned subdivisions or business enterprises if it provides a limited waiver of sovereign immunity and cost justification showing market equivalence.
