California expands ministerial housing approvals on subdivided lots
Governor Gavin Newsom signed SB 1116 on September 29, 2026. It amends Government Code sections 65852.28 and 66499.41 on ministerial approval of housing on subdivided lots: height limits apply to building height, not floor count, and new parcels on multifamily-zoned land may be as small as 480 square feet if the average is at least 600. New Civil Code section 714.9 voids deed restrictions that would preclude such housing, outside common interest developments.
