California limits ADU impact fees to floor area above 750 square feet
Governor Gavin Newsom signed SB 1117 on September 29, 2026. It amends Government Code section 66311.5 so that, for up to two accessory dwelling units on a lot, impact fees on an ADU larger than 750 square feet are charged proportionately and only on the area above 750 square feet. ADUs up to 750 square feet and junior ADUs up to 500 square feet remain exempt from impact fees.
