California exempts day care centers in residential areas from CEQA review
SB 299 (Chapter 413), approved September 20, added Section 21080.68 to the Public Resources Code, exempting from the California Environmental Quality Act any project consisting exclusively of a day care center located in a residential area. Existing law already exempted day care centers outside residential areas. The exemption excludes projects within 3,200 feet of active oil or gas extraction or refining facilities and projects on natural and protected lands.
