California voids HOA bans on energy-code-compliant window replacements
Governor Gavin Newsom signed SB 908 on September 29, 2026. New Civil Code section 4754 voids common interest development restrictions that effectively prohibit owners from replacing windows with California Energy Code-compliant windows. Associations may impose only reasonable installation restrictions and, in multifamily buildings of more than 20 units, limited aesthetic restrictions. Applications not decided in writing within 45 days are deemed approved.
